1. Introduction
1.1 These Terms and Conditions apply when you use our website or place orders for products through our online store.

2. Acceptance of the Terms
2.1 By using our website or placing an order, you confirm that:
(a) you are a natural person and at least 18 years old,
(b) you are legally capable of entering into a binding contract with us, and
(c) there are no legal or contractual barriers preventing you from entering into this agreement.
2.2 We reserve the right to ask you to confirm your eligibility to accept these terms in writing.
2.3 You further declare that:
(a) you have not been convicted of computer- or internet-related crimes, and
(b) you have not previously been denied access to our products or website.
2.4 We reserve the right to restrict or deny access to our website if we deem it necessary or appropriate.
2.5 By submitting an order, you confirm:
(a) that you have fully read and understood these terms,
(b) that your order is governed exclusively by these terms,
(c) that our order confirmation is also governed by these terms, and
(d) that you agree to comply with all conditions set forth herein.
2.6 If you do not agree with these terms, we ask that you do not use the website or place any orders.
2.7 To use certain features of the website or place orders, you must explicitly agree to these terms.
2.8 By using our website or placing an order:
(a) you also agree to our Privacy Policy, and
(b) you acknowledge our Acceptable Use Policy (see Article 12).
2.9 We recommend saving a copy of these terms for your records.
2.10 If you do not accept the terms, we advise you not to contact us or place any orders.
3. Personal Use Only
You confirm that you are using our website solely for private and personal purposes. You are not acting on behalf of a business or third party and are not purchasing products for commercial use.
4. Prices and Fees
4.1 All prices shown on our website include applicable sales taxes unless stated otherwise. Shipping costs are included unless indicated.
4.2 Additional fees such as customs duties, import taxes, or local charges are not included in the product price and are the responsibility of the customer if they apply. Please contact our customer service before purchase if you have questions.
4.3 We strive to display all product information—including prices and descriptions—as accurately as possible. If an error occurs, we will notify you immediately. You may then decide whether to proceed with the order at the corrected price or cancel free of charge.
4.4 In the case of an obvious pricing error, we are not obligated to provide the product at the incorrect price, even if you have received an order confirmation.
4.5 We reserve the right to change prices at any time. Price changes do not apply to already confirmed orders for which you have received an order confirmation.
5. Ordering and Confirmation
5.1 After you place an order, we check product availability. If the items are in stock, we will send you an order confirmation by email.
5.2 A binding purchase agreement is formed only when you receive our order confirmation—and only for the products explicitly listed in that confirmation.
5.3 If your order contains multiple products, shipments may be made in partial deliveries.
5.4 We reserve the right to remove products from our assortment at any time without notice.
5.5 We also reserve the right to decline or cancel orders—even after an order confirmation has been sent.
5.6 If we cancel a paid order, we will refund the full amount.
6. Payment
6.1 Payment can be made using the secure payment methods offered on our website. These are processed through trusted payment service providers.
6.2 We assume no liability for unauthorized or fraudulent use of your payment method by third parties—even if your payment method has been reported stolen.
6.3 You agree not to initiate unwarranted chargebacks or refund requests for valid orders.
7. Delivery
7.1 We strive to deliver your order to the shipping address provided at checkout.
7.2 An estimated delivery date will be displayed during checkout.
7.3 If delivery to your address is not possible, we will contact you. In such cases, the order will be canceled and the full amount refunded.
7.4 Once the order has been delivered to the address you provided, the risk of loss or damage transfers to you.
8. Cancellation or Modification of Your Order
8.1 After placing an order, you may modify or cancel it only by contacting us as quickly as possible by email.
8.2 If your order has already been packed and prepared for shipment, modification or cancellation is no longer possible. In this case, you may return the items after delivery according to Article 10.
If the package is already in transit, cancellation is no longer possible. However, you may notify us in advance so we can prepare the return process. To speed up processing, please provide a shipping receipt. In the event of a lost package, a refund cannot be issued until at least 16 weeks after the original order date.
8.3 Because we use a fully automated ordering system, your order is processed immediately after payment. For this reason, interruption of the shipping process is usually not possible. Only in exceptional cases can we cancel an order within 24 hours and issue a refund if appropriate.
9. Defective or Damaged Products
9.1 You acknowledge that our products are standard items and not customized to your personal requirements.
9.2 All information, descriptions, and materials on our website are provided “as is,” without explicit or implied warranties regarding suitability or accuracy.
9.3 Product images on our website are for illustration purposes only. Minor variations between images and delivered items may occur.
9.4 If you receive a damaged or defective product, please contact us immediately by email with a clear description of the issue and a photo showing the defect.
9.5 Defective products may be returned in accordance with Article 10.
9.6 Upon receiving the returned item, we will inspect it. Processing time depends on the product and current return volume.
9.7 If the defect is confirmed, we will notify you by email.
9.8 If a defect is verified, we will choose one of the following actions at our discretion:
(a) free replacement of the product and coverage of return shipping costs, provided the defective item is returned in full, or
(b) full refund of the purchase price including any return shipping costs, issued to the original payment method.
9.9 If inspection shows that no defect is present, we reserve the right to deny a refund. In this case, processing or administrative fees may be charged.
10. Returns and Refunds
10.1 Our Return Policy forms an integral part of these Terms and is a condition for using our website and making purchases.
10.2 If you are not satisfied with part or all of your order, you may exercise your right of withdrawal within 30 days from receiving the final item of your order. Please email us with the relevant product details and return the item to our return address.
10.3 Return shipping costs are your responsibility unless otherwise agreed.
10.4 A refund will only be issued after we have received and inspected the returned items.
10.5 You are responsible for ensuring safe return shipping. Items must be in original condition: unused, undamaged, complete, with all tags attached, and in their original packaging. Pack items securely.
10.6 If the return does not meet our return conditions (e.g., damaged or showing signs of use), we reserve the right to refuse it.
10.7 If the return is accepted, you will receive a confirmation email. The refund will be processed within 7 business days to the original payment method.
10.8 A refund is issued only after physical receipt and successful inspection of the returned goods.
11. Discount Codes and Vouchers
11.1 You may apply valid discount or promotional codes during checkout.
11.2 Enter the appropriate code in the field provided at checkout.
11.3 If valid, the discount will be applied automatically to the order total.
11.4 Only one discount code can be used per order.
11.5 Discount vouchers have no cash value and cannot be redeemed for money or interest.
11.6 If the discount is lower than the order total, you may pay the difference using one of the available payment methods.
12. Acceptable Use of the Website
12.1 You may not use our website in any way that affects its functionality, security, or accessibility. The following activities are prohibited:
(a) Illegal, misleading, harmful, or fraudulent activities
(b) Distribution or transmission of harmful software including viruses, spyware, trojans, or malware
(c) Automated data collection such as scraping, harvesting, or mining without prior written permission
(d) Use of bots or automated tools on our website
(e) Ignoring the instructions in our "robots.txt" file

12.2 You are personally liable for all damages or costs incurred by Moode as a result of improper use.
12.3 You agree to notify us immediately if you become aware of misuse of our website.

13.6 We reserve the right to withdraw linking permission at any time without providing reasons.

19.1 In the event of force majeure—events beyond our control lasting more than seven days—we reserve the right to immediately terminate the contract in writing. In such cases, you are entitled only to a refund for products paid for but not delivered.
19.2 We decide at our discretion how to address situations involving force majeure in order to fulfill our obligations as far as possible.

20.2 If you disagree with the new terms, we ask that you refrain from making further purchases and discontinue the use of our website.

21.1 In the event of a breach, we reserve the right to take the following measures—depending on severity:

(c) Canceling open orders

25. Governing Law
These Terms are governed by Swiss law and interpreted in accordance with the laws of Switzerland. All disputes fall under the exclusive jurisdiction of the courts at Moode’s registered office in Switzerland.
